1) Enforcement is costly.

2) If an instance of enforcement has a higher probability of success and high impact, its likely to meet the cost threshold.

3) Centralized institutions are good candidates for #2. Hard for them to evade and high impact when enforced.

On drug enforcement for instance, there is often no or very little enforcement against users, but high enforcement against dealers.

Similarly, an under the table nanny doesn't get enforced but there are no under the table daycare facilities.
